These Terms of Service ("Terms," "Agreement") govern your use of the Netzero ("we," "us," or "our") mobile application, available on the App Store and Play Store. By using the Netzero App, you agree to comply with these Terms. If you do not agree with any part of these Terms, please do not use the App.
Netzero is provided for your personal, non-commercial use only. You agree not to use the App for any illegal or unauthorized purpose. You further agree to comply with all applicable laws and regulations while using the App.
All content and materials available in the App, including but not limited to text, graphics, user interfaces, visual interfaces, photographs, trademarks, logos, and artwork ("Content"), are owned by Netzero or its licensors and are protected by copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store, or transmit any of the Content without the prior written consent of Netzero or the respective copyright owner.
The App is provided "as is" and "as available" without any warranties of any kind, whether express or implied. Netzero does not guarantee the accuracy, reliability, completeness, or suitability of the App for any purpose. You use the App at your own risk.
To the maximum extent permitted by applicable law, Netzero and its affiliates, officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from your use of the App.
Netzero reserves the right to modify or discontinue the App, or any portion thereof, with or without notice. We may also change these Terms from time to time. It is your responsibility to review these Terms periodically for any changes. Your continued use of the App after any modifications to the Terms will constitute your acceptance of the modified Terms.
These Terms are governed by and construed in accordance with the laws of the United States, without regard to its conflict of law principles.
